SHARON ZONING BOARD OF APPEALS MINUTES OF OCTOBER 26, 2011

A regular meeting of the Sharon Zoning Board of Appeals was held on Wednesday, October 26, 201 at 7:00 p.m. in the Selectmen’s Meeting Room, Second Floor, Town Office Building.   The following members were present:  Kevin McCarville, Lee Wernick, Larry Okstein, Seth Ruskin.

Mr. McCarville opened the meeting at 7:00 p.m. with the board’s and prayers and wishes for a safe return for John Lee who is serving in Afghanistan.

7:03 p.m.             David Segaloff, 1 Cheshire Drive, Case No. 1684 Continued Hearing:  The board was awaiting new plans and comments from Jim Andrews, Health Agent.  Mr. Segaloff submitted both.  There were no public comments.

The applicant asked to close the public hearing.  Mr. Wernick moved to approve the application seeking two findings and a special permit relative to a porch enclosure/habitable space expansion to a home on a nonconforming lot with the board’s standard conditions.  Motion seconded by Mr. Okstein and voted 3-0-0 (McCarville, Okstein, Wernick).

7:10 p.m.             David Conforto, 46 Harold Street, Case No. 1685 New Hearing:  Mr. McCarville read the public hearing notice and letters received from Jim Andrews, Health Agent, dated October 25, 2011 and Greg Meister, Conservation Agent, dated October 26, 2011.

Mr. Conforto stated they would like to add a 3-season deck with no heat to an existing home.   They will be adding a skylight, a window in the bedroom, but will not be increasing the nonconformity.  They will also be taking down a wall, but no plumbing will be done.  He stated he would also like to add a farmer’s porch.  Mr. McCarville asked if he is proposing downspouts for the porch and Mr. Conforto stated there will be gutters for now.   The family room is on a slab presently.  They will be covering the 3-season deck in the back and adding a farmer’s porch in the front.  The deck size will not change as they are just covering it.

Mr. Wernick stated we need plans that are signed by an engineer that also show the setbacks.  Mr. McCarville continued this hearing to November 9, 201 at 7:00 p.m. as we need certified and stamped plans.

7:22 P.M.             Rusaluddin Taj, 47 Ames Street, Case No. 1683:  Mr. McCarville read the public hearing notice and also a letter from Jim Andrews, Health Agent, stating that the applicant has not provided any septic information to him.  He noted that Mr. Meister, Conservation Agent has not responded yet.

Mr. Taj stated he lives next to the back of the high school.  Mr. McCarville stated the plans shows the driveway is from AmesStreet going in and they also want the garage closer to the side line and front line.  Mr. Taj agreed.   Mr. Taj stated there is a deck around the house presently.  Mr. Wernick stated they will be increasing the nonconformity as the deck will be 11’ from the lot line.  Mr. Taj stated the house is built very high so five years ago they built the deck up.  Mr. Wernick stated the house is 20’ from the side line and the garage will be 11’ which increases the nonconformity.  Mr. McCarville stated that is quite a bit.  He asked Mr. Taj to bring in the old permit or get a copy of it from Joe Kent.  The deck already encroaches into the setback.  He asked if they have a previous approval to do the existing deck and if so the plan would show the approved setbacks.

Mr. Ruskin asked when Mr. Taj remodeled was the deck added or was it already there.  Mr. Taj stated it was there, but broken and they did have a permit for that work.

Mr. McCarville continued this hearing to December 14, 2011 at 7:00 p.m.

7:35 p.m.             Linda McSherry, 61 Chestnut Street, Case No. 1682:  Mr. McCarville read the public hearing notice and a letter dated September 26, 2011 from Jim Andrews, Health Agent.  Mr. McCarville stated we will need input from Greg Meister, Conservation Agent, before rendering a decision.  Mr. McCarville called Mr. Meister and he gave a verbal okay and will send in a follow up letter.

Mr. McCarville stated they are proposing a full bath and den where there is presently a 3-season porch and the expansion will not increase the setbacks.  It is presently 10’x10’ and would like it to be 14’x20’ as the final dimension.  Mr. Wernick stated he would like to see a dimensional layout and an engineer needs to certify the plan.  Mr. McSherry asked if the foundation plan would be satisfactory and Mr. McCarville stated yes.  Mr. McSherry stated this is Phase 1 or a two-phase proposal.  They will be back to open up the kitchen from front to back at a later date.

Mr. McCarville continued this hearing to November 9, 2011 at 7:00 p.m.

7:55 p.m.             Kathryn Sky -Peck/Norman Boucher, 15 Samoset, Case No. 1686 Refile:  Mr. McCarville read the public hearing notice and comments from Jim Andrews, Health Agent dated October 27, 2011 and Greg Meister, Conservation Agent, dated October 25, 2011.  Mr. Andrews needed information on the septic system.  Mr. Wernick stated we need a letter and an approved plan of the layout before approving this.  Mr. Boucher asked if the board is saying that Mr. Andrews needs to give him a letter and Mr. Wernick stated we need a letter from Jim Andrews which states he approves the design.  Mr. McCarville asked if they are moving the shed off the wetlands and Mr. Boucher stated yes.  They are adding some walls and removing some walls.  The kitchen and den will be opened to a new space and the stairs will be moved.  Ms. Sky-Peck stated that her mother has moved in with them and she has Parkinson’s and therefore they need to open up some rooms.  Her mother is presently in the living room.  There will be a lav/toilet and shower instead of a just a lav and toilet.  Mr. McCarville asked if they are increasing the square footage of the house and Mr. Boucher stated yes, just a little.  Their previous submission showed an attached two-car garage under, but they reduced the scope of work in this application so there will be no setback issues.  Mr. McCarville asked what is the nonconforming structure and Mr. Wernick thinks it is the nonconforming lot and the fact that they are moving the shed.  Ms. Sky-Peck stated the shed can be put anywhere.  It doesn’t matter.  Mr. Boucher stated they were not aware of the actual property line and there is a wetland issue.   The other shed that is there is being demolished.

Mr. McCarville continued this hearing to November 9, 2011 at 7:00 p.m.

It was moved, seconded and voted to adjourn.  The meeting adjourned at 8:20 p.m.
